The masks mandates are dead: FOREVER.

“I read a column the other day by a Philip Holloway that got my attention for its headline: "The CDC’s Mask Mandate Is Dead and Won’t Be Back; Here’s Why."
We all know that Judge Kathryn Mizelle struck down the mask mandate for mass transit.
After that happened, I wrote an email to you pointing out Dr. Fauci's dismay: why are the courts involving themselves in public-health matters, he demanded to know.
Because there are legal issues involved in "public health" matters. And Judge Mizelle stuck to the legal issues.
She did not get into whether masks actually prevent the transmission of viruses. We've covered that in this newsletter and on the Tom Woods Show. For now I'll simply add this: if being unmasked on an airplane truly placed people in mortal danger, why would they still have been giving us peanuts and pretzels, which required the removal of the mask? Were those pretzels worth someone's life?
So they can't honestly believe it.
But that's not the point. The point is, the mask mandate violated not just science and common sense, but also proper procedure.
According to the Administrative Procedures Act (APA), a court must set aside an agency's action when that action exceeds the agency's authority. And as it turns out, no authority to issue a mask mandate was ever granted, and none of the words used to refer to things the CDC can do are applicable (with a straight face, anyway) to a mask mandate.
Not to mention, the CDC skipped the public notice and comment period required by the APA. Just saying that they prefer to skip it is not an argument, and as Holloway argues, it's to deal with precisely that kind of hubris that we have the APA in the first place.
The Department of Justice has not sought a stay of the Judge's ruling, though they are appealing it. The trouble for them is, the 11th Circuit Court of Appeals does not appear sympathetic to the Department of Justice's case.
The thing is dead, folks.
It sure took long enough, but it's dead.
