"…if we're not at war right now." But we are! In 1917 Congress passed the "Trading With the Enemy Act". Not repealed. In 1933 Roosevelt got the "War and Emergency Powers Act" passed. The first allowed full authoritarian control over citizens of enemy countries; the second made US citizens enemies of the federal government. None of these has been repealed.
